Playing music in public is a licensed act

Under 17 U.S.C. 106(4), performing a song in your venue needs permission from whoever controls it.

Consumer streaming plans do not count

Spotify and Apple Music personal plans prohibit commercial playback in their own terms of service.

Statutory damages run from $750 to $30,000 per work under 17 U.S.C. 504(c), and up to $150,000 where infringement is found to be willful. Minimum ASCAP and BMI licences alone came to about $817 a year in 2026, before SESAC and GMR.

Rarely, and almost never the way owners assume. The exemption in 17 U.S.C. 110(5)(B) covers restaurants and bars under 3,750 gross square feet and other businesses under 2,000, excluding parking, or larger premises staying within six loudspeakers and no more than four in any one room. It applies to ordinary broadcast radio and television only, so it stops applying the moment someone presses play on a phone, and you must not charge to hear it.
